Although it will only come into force on May 25th, 2018 after a 2 year transition period, businesses should already start to get prepared and implement the specifications. Otherwise they risk severe penalties of up to \u20ac\u00a020 million or 4 % of annual turnover.<\/p>\n<p>The present\u00a0Data Protection Directive (95\/46\/EC) dates back to the\u00a0&#8220;stone age&#8221; of data protection,\u00a0i.e. to 1995, a time where cloud computing and\u00a0companies\u00a0like Facebook, Google, WhatsApp, YouTube and Instagram didn&#8217;t exist. Consequently data protection\u00a0jurisdiction has\u00a0to be updated and modernised. \u00a0The new GDPR\u00a0 also aims to provide a higher degree of harmonisation of data protection law within the EU. The presently valid regulation of 1995 is implemented differently in the various EU countries, with the result that the level of data protection varies greatly.<\/p>\n<p>In a contribution for &#8220;Wirtschaft Tirol&#8221;, the Tyrol Chamber of Commerce journal, lawyer <em>Dr. Georg Huber, LL.M<\/em> explains which rights people will have\u00a0according to the\u00a0GDPR and which obligations companies will face. The GDPR places a lot of demands on businesses.
